Effective date: 17 April 2026. This page combines the Terms & Conditions of Service, the Legal Notice (Impressum), the Digital Services Act Contact Point, the Complaints & Alternative Dispute Resolution procedure, and the Accessibility Statement of BV CAPITAL Sp. z o.o.

PART I — Terms and Conditions of Service

1. Parties, Scope, and Relationship

These Terms and Conditions (the “Terms”) govern access to and use of the website findyourflowpub.com and all related digital products, services, downloads, subscriptions, and communications (collectively, the “Service”). The Service is owned and operated by BV CAPITAL Sp. z o.o., a limited liability company registered in Poland, with its registered office at Plac Wolnica 13/10, 31-060 Kraków, Poland, VAT ID / NIP 7792535920 (the “Company”, “we”, “us”, or “our”). References to “User”, “you”, or “your” mean any natural or legal person accessing or using the Service.

The actual sale, payment processing, billing, and global tax collection (including VAT, GST, and U.S. sales tax) are conducted exclusively by Lemon Squeezy, acting as Merchant of Record (“MoR”). By executing a purchase, the User enters into a financial transaction with the MoR and is additionally bound by the MoR’s then-current Terms of Service, in addition to these Terms.

2. Eligibility and Age Restriction

The Service and all Materials are intended solely for individuals who are at least eighteen (18) years of age and who have the legal capacity to enter into binding contracts in their jurisdiction of residence. By accessing the Service, the User represents and warrants that they meet these requirements. The Company does not knowingly collect personal data from children under the age of 16 (or 13, where applicable under U.S. COPPA). If the Company discovers that a child has created an account or submitted personal data, the account will be deleted and the data erased without undue delay.

3. Account Registration, Security, and Acceptable Use

Where the User creates an account, the User shall: (i) provide accurate, current, and complete information; (ii) maintain and promptly update account information; (iii) safeguard account credentials and restrict access to the account; and (iv) accept responsibility for all activities that occur under the account. The Company may suspend or terminate the account where it reasonably believes that these Terms have been breached or that fraudulent, unlawful, or abusive activity has occurred.

The User shall not use the Service: (a) for any unlawful, fraudulent, or harmful purpose; (b) to upload, transmit, or distribute any content that is illegal, defamatory, obscene, or that infringes third-party rights; (c) to circumvent, disable, or interfere with security-related features of the Service; (d) to engage in automated data collection (scraping, crawling, harvesting) beyond what is allowed by the Company’s robots.txt; or (e) to reverse-engineer, decompile, or attempt to derive the source code of any part of the Service.

4. Intellectual Property and Licensing

All Materials provided on the Service — including without limitation text, graphics, images, video, audio, software, compilations, trademarks, logos, brand elements, and all underlying code — are the exclusive intellectual property of the Company or its licensors, and are protected by Polish, European Union, United Kingdom, United States, and international copyright, trademark, database, and related-rights laws.

(a) Grant of License. Upon lawful purchase, the Company grants the User a single, revocable, non-exclusive, non-transferable, non-sublicensable, and limited personal license to download, access, and view the purchased Materials strictly for the User’s personal, non-commercial use.

(b) Prohibitions. The User shall not copy, reproduce, modify, translate, distribute, publicly display or perform, publish, transmit, upload, sell, rent, lease, sublicense, or create derivative works from the Materials, nor resell, share, or distribute the Materials to any third party. The User shall not remove, alter, or obscure any copyright, trademark, or other proprietary notices.

(c) AI Training and Text-and-Data-Mining Reservation. The Company expressly reserves its rights under Article 4 of Directive (EU) 2019/790 on copyright in the Digital Single Market. The Materials, any text, data, images, audio, video, metadata, or code available on the Service may NOT be used, copied, scraped, extracted, or otherwise processed for the purpose of text and data mining, or for the training, fine-tuning, evaluation, grounding, or development of any artificial intelligence, machine learning, or large language model system, in whole or in part, whether commercial or non-commercial. This reservation applies, without limitation, to general-purpose AI models within the meaning of the EU AI Act (Regulation (EU) 2024/1689). The Company treats this reservation as the machine-readable opt-out required by Article 4(3) of the DSM Directive; any unauthorised training constitutes copyright infringement and a material breach of these Terms.

(d) DMCA / Notice-and-Takedown. Copyright holders who believe that content made available via the Service infringes their rights may submit a notice under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and analogous EU / UK / Polish procedures to support@findyourflowpub.com. The notice must include the statutory elements required under the DMCA.

5. Representations, Warranties, and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND SUBJECT TO THE USER’S NON-EXCLUDABLE STATUTORY RIGHTS, THE SERVICE AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE SECURE OR FREE FROM VIRUSES, WORMS, OR OTHER HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (I) THE USER’S ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE OR MATERIALS; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORISED ACCESS, USE, OR ALTERATION OF THE USER’S TRANSMISSIONS OR CONTENT.

THE COMPANY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE MATERIALS SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE USER TO THE MERCHANT OF RECORD FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Nothing in these Terms shall exclude or limit the Company’s liability for (i) death or personal injury caused by its negligence, (ii) fraud or fraudulent misrepresentation, (iii) intentional misconduct or gross negligence, or (iv) any other liability that cannot be excluded or limited under applicable mandatory law. For consumers in the European Union, United Kingdom, Australia, and Canada, these Terms do not affect any mandatory statutory rights, and the limitations above apply only to the extent permitted by applicable consumer-protection law in the User’s country of habitual residence.

7. Indemnification

The User agrees to defend, indemnify, and hold harmless the Company and its directors, officers, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (i) the User’s violation of any term of these Terms; (ii) the User’s violation of any third-party right, including intellectual property or privacy rights; (iii) the User’s violation of any applicable law or regulation; or (iv) any unauthorised use of the Materials, including their use for AI training in breach of Section 4(c).

8. Third-Party Services and Links

The Service may contain links to, and integrations with, third-party websites, applications, or services (including the Merchant of Record Lemon Squeezy, MailerLite, Meta Platforms, Google, and others). The Company does not control and is not responsible for the content, policies, or practices of any third party. The User’s use of any third-party service is subject to that third party’s own terms.

9. Modification of the Service and of the Terms

The Company may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. The Company may also amend these Terms from time to time. Where any such amendment is material, the Company shall provide reasonable prior notice (for example, by email or by a prominent notice on the Service) at least fifteen (15) days before the amendment takes effect. Continued use of the Service after the effective date constitutes acceptance of the amended Terms; if the User does not accept the amended Terms, the User must stop using the Service. Amendments required by law or regulatory directive may take effect immediately.

10. Suspension and Termination

The Company may suspend or terminate the User’s access to the Service at any time, with or without cause and with or without notice, where the Company reasonably believes that these Terms have been breached, that the User has engaged in unlawful, fraudulent, or abusive conduct, or where required by law. Termination shall not affect any rights, obligations, or liabilities accrued prior to termination, and the provisions of Sections 4, 5, 6, 7, 11, 12, 13, and 14 shall survive.

11. Force Majeure

The Company shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, strikes or other labour disputes, power or telecommunications failures, denial-of-service attacks, and acts or omissions of government, regulatory, or supervisory authorities.

12. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict-of-law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

Any dispute arising out of or in connection with these Terms — excluding disputes directly relating to payment processing, which are governed by the MoR’s terms — shall be submitted to the exclusive jurisdiction of the competent courts of Kraków, Poland. Notwithstanding the foregoing, where the User is a consumer habitually resident in the European Union, United Kingdom, Australia, Canada, or another jurisdiction providing mandatory consumer protections, (i) the User retains the benefit of any mandatory consumer-protection rules of the User’s country of habitual residence (Article 6 of Regulation (EC) 593/2008 — Rome I) and (ii) the User may bring proceedings against the Company in the courts of the User’s country of habitual residence, and the Company may bring proceedings against the User only in those same courts (Articles 17–19 of Regulation (EU) 1215/2012 — Brussels I bis).

13. Complaints, Alternative Dispute Resolution, and ODR

Before initiating any formal proceeding, the User is encouraged to contact the Company in accordance with Part IV of this page (Complaints and Alternative Dispute Resolution). Pursuant to Article 14 of Regulation (EU) 524/2013, consumers resident in the European Union may submit disputes to the EU Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.

The Company is not obliged to, and does not currently commit to, participate in alternative dispute resolution procedures before a specific ADR entity, but will consider each request on its merits.

14. Miscellaneous

(a) Entire Agreement. These Terms, together with the Privacy and Cookie Policy, the Refund Policy, and any product-specific terms, constitute the entire agreement between the User and the Company regarding the Service and supersede all prior agreements and understandings, whether written or oral.

(b) Severability. If any provision is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced by a valid provision that most closely approximates the economic intent of the original.

(c) No Waiver. No failure or delay by the Company in exercising any right shall operate as a waiver of that right.

(d) Assignment. The User may not assign or transfer these Terms without the prior written consent of the Company. The Company may assign its rights and obligations hereunder to any affiliate or successor.

(e) Electronic Communications. The User consents to receive communications from the Company in electronic form. Electronic notices satisfy any legal requirement that such communications be in writing.

(f) Language. These Terms are concluded in the English language. Any translation is provided for convenience; the English version shall prevail in case of discrepancy, except where mandatory consumer-protection law in the User’s country of habitual residence requires otherwise.

(g) Headings. Headings are provided for convenience and do not affect interpretation.
